This Privacy Policy explains how FitMeWear ("we", "us") collects, uses, shares and protects your personal information when you use our website. We follow the Information Technology Act, 2000, the SPDI Rules, 2011, and the Digital Personal Data Protection Act, 2023.
We sell only within India, and your personal data is stored and processed in India. You can browse most of the store without creating an account. By using the site or placing an order you agree to this policy, our Terms & Conditions and the laws of India, including those on data protection and privacy. If you do not agree, please do not use the site.
1. Information we collect
- Account details — your name, email, phone number and password.
- Body measurements & Fit Profile — the measurements you enter (or that the AI tool helps you estimate) to have your shirt made. We treat these with the same care as sensitive personal information and use them only to tailor and deliver your order.
- AI Photo Measure — this optional tool is used only after you give explicit consent. You provide two photos (one front-facing, one from the side), and both are processed entirely on your own device in your browser. The photos are never uploaded, transmitted, or stored on our servers — only the resulting measurement numbers stay with your order. Because the photos never leave your device, they are never used to train AI or any other models. If you would rather not use it, enter your measurements by hand.
- Order & delivery details — shipping address, phone number, order history.
- Payment information — we currently accept Cash on Delivery and UPI on Delivery, both paid at your door, so we do not collect or store card, UPI or bank details. When online payment is enabled, it is handled on the secure page of a payment gateway authorised by the Reserve Bank of India as a Payment Aggregator, and is PCI-DSS compliant. In that case your card number, CVV, PIN, UPI PIN and net-banking password are entered on the gateway's page, never on ours, and are never sent to us or stored by us. All we receive back is the payment status, the amount, a transaction/reference number and the payment method used — enough to confirm your order, raise your invoice and process a refund, and nothing more. In line with the RBI's card-storage rules we do not keep card-on-file data.
- What we do not collect — we do not collect biometric data, facial or physiological identifiers, government ID numbers, or your bank/card credentials. The AI Photo Measure tool never sends your photos anywhere (see above).
- Usage data — basic technical information such as browser type, device type, approximate location (city level) and the pages you visit, used to run and improve the site.
2. Cookies & analytics
- Essential cookies — a session cookie keeps you logged in while you shop. Without it, accounts and checkout cannot work.
- Local storage on your device — your cart, unit preference (inches/cm) and delivery PIN code are saved in your own browser, not on our servers.
- Google Analytics 4 — we use Google Analytics to understand how many people visit and which pages they use, so we can improve the store. It sets its own cookies and may process limited data (such as device, browser, approximate city and pages viewed) on Google's servers. It does not receive your name, email, phone, measurements or photos.
- You can block or delete cookies in your browser settings, or install Google's opt-out browser add-on. The store will still work, though staying logged in requires the essential cookie.
3. Why we collect it
- To create and manage your account.
- To tailor, process, and deliver your orders.
- To provide customer support and handle grievances.
- To send order updates and, with your consent, offers.
- To comply with legal and tax obligations.
4. Consent
We collect your information only with your consent, given through an explicit affirmative action (for example, submitting a form). We do not use pre-ticked boxes. You may withdraw consent or ask us to delete your data by contacting us — note this may prevent us from fulfilling pending orders.
5. Sharing your information
We share information only as needed to run our business, and only to the extent required:
- Courier partners (currently Delhivery) — name, address and phone number, so your order can be delivered.
- SMS provider — if you log in with a one-time password (OTP), your mobile number is shared with our SMS gateway (Fast2SMS) solely to send you that message.
- Payment gateway — if you pay online, the RBI-authorised payment aggregator that processes the payment receives the order amount, order reference and the contact details it needs to complete and, if necessary, reverse the transaction. It handles your payment credentials under its own privacy policy and RBI/PCI-DSS obligations; we neither see nor store them. We use this only to take payment, verify it, issue your invoice and make refunds — not for marketing.
- Hosting, IT & security providers — our website and database are hosted in a data centre operated by our hosting provider, and we use a content-delivery and security network (Cloudflare) that processes basic connection data (such as your IP address) to keep the site fast and protected against attacks.
- Google Analytics — anonymous usage statistics only (see section 2).
- Legal authorities — where disclosure is required by law.
We do not sell or rent your personal data to anyone.
6. How long we keep it
We keep your account and order records for as long as your account is active and for as long afterwards as tax and accounting law requires (generally up to 8 years for invoices). Your measurements and Fit Profiles are kept so you can reuse them, and are deleted when you ask us to delete them or close your account. AI Photo Measure photos are never stored at all.
7. Children
Our store is not intended for children under 18. We do not knowingly collect personal data from children. If you believe a child has given us personal data, contact us and we will delete it.
8. Data security
We follow reasonable security practices to protect your information against unauthorised access, alteration, or disclosure — including HTTPS encryption, hashed passwords and access controls. No method of transmission over the internet is 100% secure, but we work to safeguard your data. In the unlikely event of a personal-data breach that affects you, we will notify you and the Data Protection Board of India as required by law. Please also keep your own account password confidential.
We will never ask you for a PIN, password or OTP. If someone emails, calls or messages you claiming to be
FitMeWear and asks for your card PIN, CVV, net-banking or UPI password, or an OTP, it is a fraud — do not share it. We only ever ask for payment at your door, at the amount printed on your invoice. If you have already shared such details, contact your bank and report it to the nearest cyber-crime authority, and tell us at
[email protected].
9. Your rights
Under the SPDI Rules, 2011 and the Digital Personal Data Protection Act, 2023, you have the right to:
- Access — ask for a summary of the personal data we hold about you.
- Correct & update — have inaccurate or incomplete data fixed.
- Erase — ask us to delete your data (except records we must keep by law, such as tax invoices).
- Withdraw consent — as easily as you gave it; note this may prevent us from fulfilling pending orders.
- Grievance redressal — raise a complaint with our Grievance Officer (below).
- Nominate — nominate another person to exercise these rights on your behalf, for example in the event of death or incapacity.
To exercise any of these, email our Grievance Officer at [email protected] with your request. We may verify that the request is really from you before acting on it. We respond within a reasonable time and confirm once it is done.
If you have an order, payment, return or complaint still open, we may hold a deletion request until it is settled — otherwise we could not finish delivering or refunding your order. Deleting your account also removes your saved measurements and Fit Profiles, and that cannot be undone. Records we are legally required to keep (such as tax invoices) are retained for the period the law requires, and anonymised statistics that cannot identify you may be kept for analysis.
