These Terms & Conditions govern your use of the FitMeWear website and your purchases from us. By using the site or placing an order, you agree to these terms.

This document is an electronic record under the Information Technology Act, 2000 and the rules made under it, including the amended provisions on electronic records. It is generated by a computer system and does not require any physical or digital signature. It is published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines) Rules, 2011, which requires the rules and regulations, privacy policy and terms of use for access and usage of https://fitmewear.com/ to be published on the website.

Any terms or conditions you propose that add to, or conflict with, these Terms are not accepted by us and have no effect unless we agree to them in writing.

1. Who we are

This website is operated by FitMeWear LLP, Plot 4-A, Vikas Nagar, Uttam Nagar, Delhi — 110059, India. You can reach us at [email protected] or +91 8285377372.

2. Eligibility

You must be at least 18 years old (or have parental consent) to place an order.

3. Products & made-to-measure nature

Our products are made to order based on the measurements you provide. Because each item is stitched specifically for you, accurate measurements are your responsibility. Colours may vary slightly from what appears on your screen.

4. AI Photo Measure (beta feature)

Our AI Photo Measure tool is an optional aid that is currently in beta (testing). It estimates your measurements from two photos you provide. Because results depend on your photos, posture, clothing and lighting, the values it produces are estimates only and may not be exact. You must review every value and correct anything that looks wrong before placing your order — the measurements submitted with your order remain your responsibility (see section 3). Your photos are processed on your own device and are never uploaded to us (see our Privacy Policy). If you prefer, enter your measurements manually instead.

5. Pricing & payment

• All prices are in Indian Rupees (₹) and are inclusive of all taxes. The checkout shows the full breakup — subtotal, any discount, delivery and taxes — and the "Total payable" figure is the entire amount. We add no delivery charge, handling charge, convenience fee or payment-gateway fee.
• Country of origin of goods: India.
• We currently accept Cash on Delivery and UPI on Delivery — either way, you pay only when your order reaches your door. Any additional payment methods will be shown at checkout when available.
• By placing an order you enter into a legally binding contract with us for that order.
• If a price is displayed in error, we reserve the right to correct it and cancel any affected order, with a full refund.

6. How you pay, and how your payment is protected

The methods available to you are always the ones shown on the checkout screen. Today that is Cash on Delivery and UPI on Delivery. When online payment is switched on, cards, UPI, net-banking and wallets will appear there too, handled by a payment gateway authorised by the Reserve Bank of India as a Payment Aggregator.

• We never see or store your payment credentials. If you pay online you are taken to the gateway's own secure page. Your card number, CVV, PIN, UPI PIN and net-banking password are entered there, not on our website, and they are never sent to us or stored by us. In line with the RBI's card-storage rules we do not keep card-on-file data — only a token or reference issued by the gateway, which cannot be used to make a payment anywhere else.
• No charge is added for paying. There is no gateway fee, convenience fee, COD fee, delivery charge or handling charge. The amount shown as "Total payable" at checkout is the whole amount, inclusive of all taxes.
• No auto-debit, no subscription, no saved mandate. Every order is a one-time payment that you authorise yourself. We do not set up standing instructions or e-mandates, so there is nothing recurring for you to cancel later.
• An online payment is verified before your order is confirmed. When you pay online your order first appears as Payment received — awaiting confirmation. We check the payment against our payment-gateway account and only then confirm the order and begin stitching. You will get a separate confirmation once that check is done. Until then, please do not pay a second time.
• If a payment fails, your money comes back to you. Where an amount has left your account but the payment did not succeed, the reversal is handled as set out in our Returns, Refunds & Cancellation Policy, which follows the RBI's prescribed turn-around times for failed transactions.
• Duplicate payments are refunded in full. If the same order is paid for twice, tell us and we return the extra amount to the source account. You are never asked to absorb it.
• Chargebacks. If you believe a payment was taken in error, please contact us first — it is usually the fastest route. You also keep your right to raise a chargeback or dispute directly with your card issuer or bank under their rules.
• If a payment problem is not resolved. Write to us first (details in section 18). If you are still not satisfied, you may take it up with the payment gateway's own grievance officer, whose details are published on the gateway's website, and after that with the Reserve Bank of India's Integrated Ombudsman scheme at cms.rbi.org.in.
• We are not liable for the gateway or your bank being down. If a payment cannot be completed because of a failure at the gateway, your bank or the UPI network, we will help you complete or reverse it, but we cannot be held responsible for that failure itself.

7. Your account & acceptable use

You are responsible for keeping your account details and password confidential, and for activity that happens under your account. Tell us immediately if you suspect unauthorised use. Please give accurate contact and delivery details — we are not responsible for failed deliveries caused by incorrect details.

You agree to use the site fairly and lawfully. You must not attempt to gain unauthorised access to any part of the site or its systems, reverse-engineer or copy our software, scrape or harvest data, or do anything that disrupts, overloads or interferes with the service or other users. We may suspend or close any account involved in fraud, abuse, or a breach of these terms.

8. Orders

An order is confirmed once you complete checkout and receive confirmation. We may refuse or cancel an order in cases of suspected fraud, pricing errors, or unavailability, with a refund where payment was made.

9. Returns, refunds & delivery

These are governed by our Returns & Refund Policy and Shipping Policy, which form part of these terms.

10. Intellectual property

All content on this site — logos, text, and images we own — belongs to FitMeWear and may not be copied or reused without permission.

11. Accuracy of information on this site

We take care to keep prices, product descriptions, fabric details and delivery estimates correct and up to date. Even so, the site may occasionally contain an error or an out-of-date detail, and we do not warrant that all information is complete, accurate or suitable for a particular purpose. Where an error affects your order, section 5 (pricing errors) and section 8 (orders) apply, and you will always be offered a correction or a full refund rather than being held to the mistake.

12. Links to other websites

Some parts of the site link to services we do not run — for example signing in with Google. When you follow such a link, that service's own terms and privacy policy govern your use of it, and we are not responsible for its content or practices. Links are provided for your convenience only.

13. Limitation of liability

To the extent permitted by law, our liability for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing here limits your statutory rights under Indian consumer law.

14. Indemnity

You agree to indemnify and hold harmless FitMeWear LLP, its partners, employees and service providers against any claim, demand, loss, penalty or reasonable legal cost brought by a third party or imposed by an authority that arises out of your breach of these Terms, our Privacy Policy or our other policies, your violation of any law, or your infringement of someone else's rights (including intellectual-property rights).

15. Events outside our control (force majeure)

Neither you nor we are liable for failing to perform an obligation under these Terms where performance is prevented or delayed by an event beyond reasonable control — for example a natural disaster, strike, riot, epidemic, fire, flood, power or internet failure, courier disruption, or a government order or restriction. If such an event delays your order we will keep you informed, and if it cannot be fulfilled we will refund you in full.

16. Changes to these terms

We may update these Terms from time to time — for example when we add a payment method or change a policy. The current version always appears on this page with its "Last updated" date, and it applies to orders placed after that date. Please check this page from time to time.

17. Governing Law & Jurisdiction

These policies and terms shall be governed and construed in accordance with the laws of India. Any dispute or claim relating to them, or to their enforceability, shall be subject to the exclusive jurisdiction of the competent courts at Delhi, India.
